Terms and Conditions of all photography jobs

The client agrees that by paying a deposit and making a booking that they have read, understood and agree to the terms and conditions below.

COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. The photographer recommends that Client designate an "event guide" to point out important individuals for informal or candid photographs to the photographer and/or his assistant during the wedding that they wish to have photographed. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. The photographer is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to the photographer. If the bride's or grooms late arrival prevents the photographer from capturing particular photographs the photographer shall not be held liable for failure to take desired photographs. The photography schedule and selected methodology are designed to accomplish the goals and wishes of the Client in a manner enjoyed by all parties. Client and the photographer agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time.

HOUSE RULES: The photographer is limited by the guidelines of the ceremony site/official or reception site management. Client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is Client's responsibility; the photographer will offer technical recommendations only.

COPYRIGHT: Copyright of images on the Hi-Res DVD remains with the photographer—the client also has joint access and/or copyright to the images for all their usage purposes.  Images in any other format or on any other medium copyright remains with the photographer. Specific images to be used by the photographer in the future. Client grants the photographer permission to display images resulting from this assignment as an example of the photographer‘s photographic work and for entrance into photographic competitions and release all claims to profits that may arise from use of images. The Client warrants that all people associated with the event and appearing in any images associated with the event have given their consent to be photographed. The Client hereby grants to the photographer and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Clients or in which the Client and/or any other persons associated with the event may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same and to license use of same to others to use. The Client hereby agrees to indemnify the photographer from any claim whatsoever from such use and also indemnifies and releases Roy Leigh Photographer and its legal representatives and assigns from all claims and liability relating to use of said photographs.

LIMITS OF LIABILITY: In the unlikely event that the photographer is injured or becomes too ill to photograph the event, or is unable to photograph the event for any reason whatsoever, the photographer will make every effort to secure a replacement photographer. In such a situation and without further notice this agreement is at an end and any further contractual obligations and or liabilities will be solely between the client and the replacement photographer. The Client hereby indemnifies Roy Leigh and its legal representatives and assigns from all claims and liability whatsoever arising between the client and the replacement photographer and the client also indemnifies and releases Roy Leigh Photographer and its legal representatives and assigns from all claims and liability relating to the replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. The photographer takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond the photographer’s control, Roy Leigh Photographer‘s liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. The photographer accepts no liability whatsoever resulting from coverage of this event. The Client hereby agrees to indemnify, defend and/or hold harmless Roy Leigh and its legal representatives and assigns from all claims damages, expenses and liability whatsoever arising out of or connected with any actual or threatened lawsuit, claim or legal proceedings insofar as it relates to this wedding or event.

SECURITY DEPOSITS: A deposit is required to reserve your special day. In the event of cancellation by the client, the security deposit paid is non-refundable. It shall be liquidated damages to the photographer in the event of a breach of contract by Client.

COMPLETION SCHEDULE: Image adjustments, CD, DVD and proofs take approx 2 days - 6 weeks.
