Terms and Conditions of all photography jobs
The client agrees that by paying a deposit and making a booking that they have read, understood and agree to the terms and conditions below and that a binding contract is entered into.
COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. The photographer recommends that Client designate an "event guide" to point out important individuals for informal or candid photographs to the photographer and/or his assistant during the wedding that they wish to have photographed. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. The photographer is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to the photographer. If the bride's or grooms late arrival prevents the photographer from capturing particular photographs the photographer shall not be held liable for failure to take desired photographs. The photography schedule and selected methodology are designed to accomplish the goals and wishes of the Client in a manner enjoyed by all parties. Client and the photographer agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time. Whilst the photographer tries to cover all situations the photographer will use their discretion and experience and work within their limits only to capture all the images and scenarios they possibly can.
HOUSE RULES: The photographer is limited by the guidelines of the ceremony site/official or reception site management. Client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is Client's responsibility; the photographer will offer technical recommendations only.
COPYRIGHT: Copyright of all images on the Hi-Res DVD or in any other format remains with the photographer—the client is free to copy and use the images in any manner they please. Images in any other format or on any other medium copyright remains with the photographer. Specific images to be used by the photographer in the future. Client grants the photographer permission to display any images resulting from this assignment as an example of the photographer‘s photographic work including Facebook and for entrance into photographic competitions and release all claims to profits that may arise from use of images. The Client warrants that all people associated with the event and appearing in any images associated with the event have given their consent to be photographed and appear in all media thereafter. The Client hereby grants to the photographer and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Clients or in which the Client and/or any other persons associated with the event may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same and to license use of same to others to use. The Client hereby agrees to indemnify the photographer from any claim whatsoever from such use and also indemnifies and releases Roy Leigh Photographer and its legal representatives and assigns from all claims and liability relating to use of said photographs. We take beautiful photographs and love to show them off!
LIMITS OF LIABILITY: We are one of the few fully insured professional photographers. In the unlikely event that the photographer is injured or becomes too ill to photograph the event, or is unable to photograph the event for any reason whatsoever, the photographer will make every effort to secure a replacement photographer. In such a situation and without further notice this agreement is at an end and any further contractual obligations and or liabilities will be solely between the client and the replacement photographer. The Client hereby indemnifies Roy Leigh and its legal representatives and assigns from all claims and liability whatsoever arising between the client and the replacement photographer and the client also indemnifies and releases Roy Leigh Photographer and its legal representatives and assigns from all claims and liability relating to the replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. It is the clients responsibility to ensure the photographer has access to and is able to arrive at the event safely by whatever means and cover the event safely and is not thwarted by weather, riots persons or anything that will prevent them attending or covering the event The photographer is not responsible nor in breach of this agreement whatsoever if their ability to attend or cover the event safely is thwarted. The photographer takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond the photographer’s control, Roy Leigh Photographer‘s liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. The photographer must abide by all workplace health and safety rules, practices and laws wherever the photographer may be covering an event and will not be held liable to to the client for an inability to cover any part of the event on these grounds. The photographer accepts no liability whatsoever resulting from coverage of this event. The Client hereby agrees to indemnify, defend and/or hold harmless Roy Leigh and its legal representatives and assigns from all claims damages, expenses and liability whatsoever arising out of or connected with any actual or threatened lawsuit, claim or legal proceedings insofar as it relates to this wedding or event. We will provide you with you images on a digital media. You must back up and save your images on other media as we do not keep all your images once you have received them. You must copy them to another computer hard drive upon receipt from us and notify us immediately if you are unable to copy any to your computer hard drive. You must also make sufficient backups of same to ensure your images are stored in a retrievable manner. These are your beautiful wedding images—you must back them up often and protect them for future generations!!
SECURITY DEPOSITS: A deposit and final payment in full is required to reserve your special day as is the final payment prior to your event/wedding. In the event of cancellation by the client, the security deposit and final payment paid is non-refundable. There is no refund on the final payment and/or any payments made on your final invoice as we have reserved that date exclusively for you. If we can secure another similar event on the same date as your cancellation we are only too happy to refund your payments. So please advise of a cancellation as soon as possible. Also the deposit and final payment shall be liquidated damages to the photographer in the event of a breach of contract by Client. And final payments are due 90 days prior to your event, we will email you an invoice. Only for ceremonies scheduled to commence before 2.55pm add $95.00 and before 1.55 pm please add $195.00 to your invoice. Ceremonies from noon with evening receptions please add $295.00 to your invoice.
COMPLETION SCHEDULE: Image adjustments, CD, DVD and proofs take approx 2 - 8 weeks and films a few weeks longer than this.
